Purpose
These terms govern the use of Vocatly, a service published by Henri Bernard, entrepreneur individuel. Vocatly lets an independent professional create a site from a description of their activity, host it at an address on vocatly.site or under their own domain name, and receive appointments, messages and newsletter sign-ups through it.
By opening an account, you accept them. The service is intended for professionals, in the course of their activity.
The account
An account belongs to one person and carries one site. You are responsible for your credentials and for what is done from your account. The account’s e-mail address receives the appointments and messages from your site: it must remain valid.
Trial and subscription
The subscription costs €25 a month including all taxes. It starts with a 14-day free trial. Your card is requested when you subscribe, but nothing is charged before the trial ends; if you cancel before then, nothing is charged at all.
Payment is by card, through Stripe. Your card details do not pass through our servers. An invoice is issued every month; it is available from the subscription management portal, reached from the settings.
You can cancel at any time from that portal. Cancellation takes effect at the end of the period already paid: the site stays online until then, and nothing is charged afterwards.
The price may change. You will be told by e-mail at least thirty days before a new price applies to your subscription, and you can cancel before it does.
Failed payment
If a payment fails, the site stays online for 7 days, giving you time to update the payment method from the portal. After that, the site is taken offline until payment resumes. Nothing is erased: the content, the appointments and the subscribers are kept, and the site comes back as it was as soon as payment resumes. We do not close an account that stays offline: it waits for you as long as it takes.
Your content
You are the publisher of your site. What is published there — texts, photos, services, prices — is your responsibility, including what the model wrote from your instructions and you kept. You warrant that you have the right to use the texts and photos you put on it.
The following are prohibited: unlawful, infringing, defamatory or misleading content; unfounded health claims and promises of a cure; impersonating a person or a professional title; using the site to send unsolicited messages. Vocatly may remove content or take offline a site that breaks these rules, after warning you, except in an emergency.
Your site carries its own legal notice and its own privacy page, filled in with what you tell us. You check that they are accurate and complete for your profession.
Availability and backups
We do what is needed to keep your site online and to have your data backed up regularly by our hosting providers. This is a best-efforts obligation: an outage at a provider, maintenance or an incident can make the site unavailable for a time, and we do not guarantee an availability rate.
The site is written by a language model from what you say. It can be wrong. Reread the prices, the opening hours and the texts before publishing, and correct them: we do not guarantee the accuracy of what is generated.
Intellectual property
Your content remains yours. You grant us only the right to host, reproduce and display it to run your site, for as long as your account exists.
The platform — the software, the booking, form and newsletter components, the layouts, the Vocatly name — remains with Henri Bernard, entrepreneur individuel. You acquire no right over it beyond the use of the service. What you take with you when you leave is your content and your data, not the software that displays them.
Deleting the account and leaving
You can delete your account at any time from the settings. Before doing so, you can retrieve what is yours: your content, your appointments, your messages and your subscriber list — the subscriber list downloads from the Inbox, and for the rest just write to us at henri@vocatly.com: we send it to you within the month. Your domain name is yours: it is detached from Vocatly and you keep it.
Deletion erases the site, its content, its data and the upcoming appointments; clients who had an appointment are notified by e-mail. The subscription is cancelled. Invoices are kept for as long as the law requires. Deletion is immediate and cannot be undone.
Liability
Vocatly is a tool. You remain responsible for your activity, your appointments and your clients. We are not liable for the consequences of content you published, of a missed appointment or of an unread message.
Our liability is limited to direct damages and, in any event, to the amount you paid us over the last twelve months.
Changes to these terms
These terms may change. A change that affects you is announced by e-mail at least thirty days before it applies. You can cancel before that date; continuing to use the service afterwards counts as acceptance.
Governing law and disputes
These terms are governed by French law. In case of disagreement, write to us first at henri@vocatly.com: most difficulties are settled that way. Failing that, the courts of Paris have jurisdiction.
Vocatly is offered to professionals for the needs of their business: consumer mediation does not apply.
